This Privacy Policy describes how Designer Optics Corp ("Designer Optics," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit or make a purchase from designeroptics.com, our customer account pages, our contact lens prescription portal, our prescription lens ordering tools, and when you communicate with us by email, phone, chat, or text message (together, the "Services"). It also explains the choices and rights you have, including rights under California and other U.S. state privacy laws.

1. Summary
- We collect the information you give us (name, contact details, shipping and billing addresses, payment details processed by our payment providers, and, for prescription eyewear and contact lenses, your prescription and the details of your eye care professional).
- We automatically collect device and usage information when you visit our website through cookies, pixels, and similar technologies.
- We use analytics and advertising partners. Some of this activity is a "sale" or "sharing" of personal information under California law. You can opt out at any time through the Your Privacy Choices link in the footer of our website, by enabling the Global Privacy Control signal in your browser, or by emailing support@designeroptics.com.
- Your prescription is health information. We use it only to fill, verify, and service your order, and we do not sell it or use it for advertising.
- You may request access to, correction of, or deletion of your personal information at any time.
2. Information we collect
2.1 Information you provide to us
- Identity and contact information: name, email address, phone number, shipping and billing addresses, account username and password.
- Order and payment information: the products you order, order history, and payment information. Card numbers are collected and processed by our payment providers (Shopify Payments, Shop Pay, PayPal, and the buy-now-pay-later providers offered at checkout). We do not store full card numbers on our own systems.
- Prescription and vision information: for prescription eyeglasses, prescription sunglasses, and contact lenses, your eyeglass or contact lens prescription (including sphere, cylinder, axis, add power, base curve, diameter, pupillary distance, and brand), prescription expiration date, the name and contact details of your eye care professional, and any prescription image you upload. This is sensitive personal information and, in some states, consumer health data. See Section 7.
- Communications: the content of emails, chats, support tickets, phone calls, text messages, reviews, and survey responses you send us.
- Marketing preferences: your email and text message subscription choices.
2.2 Information collected automatically
When you visit our website we and our service providers automatically collect device and usage data using cookies, pixels, tags, local storage, and similar technologies. This includes IP address, approximate location derived from IP address, device and browser type, operating system, language, screen size, the pages and products you view, the referring page or advertisement, search terms used on our site, items added to your cart, time spent on pages, and identifiers stored in cookies. Section 5 explains the technologies we use and how to control them.
2.3 Information from other sources
We receive information from Shopify (our e-commerce platform), payment providers, shipping carriers, fraud prevention providers, advertising and analytics partners (such as which advertisement brought you to our website), affiliate networks, and, for contact lens orders, from your eye care professional when we verify your prescription.
3. How we use personal information
- To process, fill, ship, and service your orders, including manufacturing prescription lenses and verifying contact lens prescriptions as required by the Federal Trade Commission Contact Lens Rule and applicable state law.
- To create and manage your customer account, save your prescriptions for reorders, and remember your preferences.
- To communicate with you about orders, returns, prescriptions, and customer service requests.
- To send marketing emails and text messages when you have signed up for them. You can unsubscribe at any time.
- To operate, secure, and improve our website, including analytics, testing, and troubleshooting.
- To show you advertising for our products on other websites, apps, and search engines and to measure the performance of our advertising.
- To detect and prevent fraud, abuse, and security incidents.
- To calculate taxes, duties, and shipping costs.
- To comply with legal obligations, enforce our terms, and protect our rights and the rights of others.
4. How we disclose personal information
4.1 Service providers and contractors
We disclose personal information to companies that perform services for us under contract and are restricted from using it for their own purposes. These include:
- Platform and payments: Shopify Inc. (store hosting, checkout, Shopify Payments, Shop Pay, Shop app), PayPal, and other payment processors.
- Order fulfillment: our optical laboratory partners, contact lens distributors, and shipping carriers; W3trends (order status and product options tools); Fordeer (invoices); Flot Delivery; Navidium (shipping protection); Seal Subscriptions (subscription orders).
- Prescription services: our prescription lens ordering tools and our contact lens prescription portal, and the eye care professional who issued your prescription, for verification.
- Customer communications: Klaviyo (email and text message marketing and transactional messages), our chat and help desk tools, Judge.me (product reviews), Hulk Form Builder (web forms).
- Tax, duties, and compliance: Avalara (sales tax), Zonos (international duties and taxes).
- Fraud prevention and security: Kount (an Equifax company), Shopify fraud analysis, BrandLock (coupon-code protection).
- Site features and analytics: Boost Commerce (search and filtering), Wishlist Hero (wishlists), Magic Toolbox (product imagery), Analyzify and Elly (analytics tagging), Google Analytics, our own first-party analytics infrastructure hosted on Google Cloud, Rewind (backups), Pandectes (consent management).
4.2 Advertising and analytics partners (sale or sharing of personal information)
We work with advertising partners that collect identifiers, device information, and browsing activity on our website through cookies and pixels, and combine it with information they hold about you, to show you our advertisements on other websites and apps and to measure advertising results. These partners currently include Google (Google Ads, Google Analytics), Microsoft Advertising, Meta Platforms (Facebook and Instagram), OpenAI (ChatGPT advertising), and impact.com (affiliate network). Our advertising partners may change; the current list is always shown in the cookie declaration available through the Your Privacy Choices link.
Under the California Consumer Privacy Act and similar state laws, this disclosure for cross-context behavioral advertising is treated as a "sale" or "sharing" of personal information, and the use of analytics and advertising cookies is treated as "targeted advertising." You may opt out at any time as described in Section 6. We do not knowingly sell or share the personal information of consumers under 16 years of age.
4.3 Other disclosures
- Legal and safety: to comply with law, subpoenas, court orders, or lawful requests from public authorities; to enforce our terms; to protect the rights, property, or safety of Designer Optics, our customers, or others.
- Business transfers: in connection with a merger, acquisition, financing, or sale of all or part of our business.
- With your direction: when you ask us to share information, for example with a family member, your eye care professional, or a third-party service.
We do not sell or share prescription or other health information for advertising, and we do not sell personal information for money.
5. Cookies, pixels, and tracking technologies
Our website uses these categories of technologies:
- Strictly necessary: required for the website, cart, checkout, security, and fraud prevention to work. These cannot be turned off.
- Functional: remember your preferences such as currency, country, wishlists, and saved prescriptions.
- Performance and analytics: help us understand how visitors use the website so we can improve it.
- Targeting and advertising: set by our advertising partners to show you relevant advertisements on other websites and to measure advertising results.
Your choices. A privacy banner is shown to visitors in jurisdictions that require consent, including California, the European Union, the United Kingdom, and Canada. In those jurisdictions, analytics and advertising technologies are not activated unless you choose to accept them, and you can change your choice at any time through the Your Privacy Choices link in the footer of every page. All visitors can use that link to opt out of analytics and advertising cookies, and all visitors can use browser settings to block or delete cookies. Blocking strictly necessary cookies may prevent the website, cart, or checkout from working.
Global Privacy Control. We honor the Global Privacy Control (GPC) browser signal. When we detect the signal, we treat it as a request to opt out of the sale and sharing of personal information and of targeted advertising for that browser. We do not respond to "Do Not Track" signals because there is no common industry standard for them.

6. Your privacy rights
6.1 Rights available to all customers
Regardless of where you live, you can:
- Access, update, or delete the information in your customer account by logging in or by contacting us.
- Unsubscribe from marketing emails using the link in any email, and from text messages by replying STOP.
- Opt out of analytics and advertising cookies through the Your Privacy Choices link.
- Ask us questions about our privacy practices at support@designeroptics.com.
6.2 Rights for residents of California and other U.S. states
If you live in California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, or another state with a consumer privacy law, you may have the following rights, subject to the exceptions in those laws:
- Right to know and access: to confirm whether we process your personal information and to receive a copy of the specific pieces of personal information we hold, the categories collected, the sources, the purposes, and the categories of third parties to whom it was disclosed, sold, or shared.
- Right to correct inaccurate personal information.
- Right to delete personal information we collected from you, subject to legal retention requirements (for example, we must keep transaction records and contact lens prescription verification records for the periods required by law).
- Right to data portability: to receive your information in a portable and readily usable format.
- Right to opt out of the sale or sharing of personal information, of targeted advertising, and of profiling in furtherance of decisions that produce legal or similarly significant effects (we do not engage in such profiling).
- Right to limit the use and disclosure of sensitive personal information. We use your prescription only to fill, verify, and service your order and to keep it on file for your reorders. We do not use it for advertising or for any other purpose that would require a limit request.
- Right to non-discrimination: we will not deny you goods or services, charge different prices, or provide a different level of service because you exercised your rights.
- Right to appeal: if we decline to act on your request, you may appeal by replying to our decision or emailing support@designeroptics.com with the subject line "Privacy Appeal." We will respond within the time required by your state's law and tell you how to contact your state Attorney General if you are not satisfied.
How to exercise these rights. Email support@designeroptics.com with the subject line "Privacy Request," call 718-412-0407, or write to Designer Optics Corp, Privacy Requests, 791 Kent Avenue, Brooklyn, NY 11205. To opt out of sale, sharing, and targeted advertising, use the Your Privacy Choices link in the website footer or enable the Global Privacy Control signal in your browser. We will confirm receipt of access, correction, and deletion requests within 10 business days and respond within 45 days, which we may extend once by a further 45 days where permitted by law; we will tell you if we need more time.
Verification. To protect your information, we will verify your identity before acting on an access, correction, or deletion request, usually by matching the email address, name, and order details in our records, or by asking you to confirm the request from the email address associated with your account. Opt-out requests do not require verification.
Authorized agents. You may designate an authorized agent to make a request on your behalf. We will require written proof of the agent's authority and may also ask you to verify your identity directly with us.

We do not collect biometric information, precise geolocation, or protected classification data, except that a prescription may incidentally reveal a vision condition.
Notice of financial incentive. We may offer a discount code when you sign up for our email or text message list. The discount is offered in exchange for your contact information, which we value based on the expected revenue from marketing communications. You may withdraw at any time by unsubscribing; the discount is not affected.
Shine the Light. California residents may request a list of the third parties to which we disclosed personal information for their own direct marketing purposes during the preceding year by emailing support@designeroptics.com.
7. Prescription and health information; Washington, Nevada, and Connecticut consumer health data notice
Your eyeglass and contact lens prescriptions, pupillary distance, and related details are health information. This section also serves as our Consumer Health Data Privacy Policy under the Washington My Health My Data Act, Nevada Senate Bill 370, and the Connecticut Data Privacy Act.
- Categories collected: prescription values, prescription expiration date, brand and lens parameters, prescription images you upload, and the name and contact details of your eye care professional.
- Sources: you, and your eye care professional when we verify a contact lens prescription.
- Purposes: manufacturing and supplying the eyewear or lenses you order; verifying contact lens prescriptions as required by the FTC Contact Lens Rule; keeping your prescription on file for reorders when you ask us to; customer service; complying with legal record keeping duties.
- Disclosures: to our optical laboratories and contact lens distributors that fill your order, to the prescription ordering tools and portal we use to process it, and to your eye care professional for verification. We do not sell consumer health data and we do not share it with advertising partners. We do not use geofencing around health care facilities.
- Your rights: you may access, correct, or delete your consumer health data, withdraw consent to further collection, and receive a list of the third parties with whom it was shared, by emailing support@designeroptics.com. If we deny your request you may appeal as described in Section 6.2; if the appeal is denied you may contact your state Attorney General.
8. Marketing emails and text messages
We send marketing emails and text messages only to people who have signed up. Text message consent is not a condition of purchase; message and data rates may apply; message frequency varies. Reply STOP to any text message to cancel and HELP for help, or email support@designeroptics.com. We will still send transactional messages about your orders. Our email and text message provider is Klaviyo. Mobile phone numbers and text message consent are not shared with third parties for their own marketing purposes.
9. Data retention
We keep personal information for as long as needed for the purposes described in this policy, and then delete or de-identify it, following the retention periods in Section 6.3. In summary: order and transaction records are kept for 7 years for tax, accounting, warranty, and dispute purposes; contact lens prescription verification records are kept for at least 3 years as required by federal law; prescriptions saved to your account remain until you delete them or close your account; marketing subscription records are kept until you unsubscribe plus a suppression record so we do not contact you again; website analytics and advertising data are kept for up to 26 months; customer service communications for up to 3 years. We may keep information longer where required by law or to resolve disputes.
10. Security
We maintain administrative, technical, and physical safeguards designed to protect personal information, consistent with the New York SHIELD Act and other applicable laws, including encryption of data in transit, access controls, and use of PCI-DSS compliant payment providers. No system is completely secure. If we learn of a security breach affecting your personal information, we will notify you and the relevant authorities as required by law.
11. Children
Our Services are intended for adults. Although we sell children's eyewear, we sell to parents and guardians. We do not knowingly collect personal information from children under 13, and we do not knowingly sell or share the personal information of anyone under 16 or use the personal information of anyone under 18 for targeted advertising. If you believe a child has provided us with personal information, contact us at support@designeroptics.com and we will delete it.
12. International customers
We are located in the United States and ship to customers in Canada, the United Kingdom, the European Union, and other countries. Your information is processed in the United States and in the countries where our service providers operate. If you are in the European Economic Area, the United Kingdom, or Switzerland, we process your personal data on the following legal bases: performance of our contract with you (orders, accounts, customer service); our legitimate interests (site security, fraud prevention, improving our Services, direct marketing to existing customers where permitted); your consent (analytics and advertising cookies, marketing to prospects); and compliance with legal obligations. You have the right to access, rectify, erase, restrict, or object to the processing of your personal data, to data portability, to withdraw consent at any time, and to lodge a complaint with your local data protection authority. International transfers to us rely on the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum where required. If you are in Canada, you may withdraw consent and request access to or correction of your personal information as provided by PIPEDA and Quebec Law 25. 13. Third-party websites and social media
Our website contains links to third-party websites, social media pages, and payment services. Their privacy practices are governed by their own policies, and we encourage you to read them.
14. Changes to this policy
We may update this Privacy Policy from time to time. We will post the updated policy on this page with a new "Last updated" date, and if the changes are material we will provide additional notice, such as an email or a notice on our website.
